FOLA Submissions: Civil Rules Review

In the Fall of 2023 Chief Justice Morawetz of the Superior Court of Justice and Attorney General Doug Downey announced their support for a comprehensive review of the Rules of Civil Procedure. The proposal is a complete overhaul of the Rules of Civil Procedure. The Civil Rules Review Working Group’s website is here.

FOLA has provided, and continues to provide feedback at every step of the consultation.

PHASE 1

January to April 2024: The CRR Working Group Phase 1 Consultation Paper requests feedback, here.
April 5, 2024: FOLA submits feedback with a letter here and answers to the questionnaire here.
May 2024: The CRR Phase 1 Report is here.

PHASE 2

April 2025: The CRR Working Group Phase 2 Report is here.
April 17, 2025: FOLA holds a town hall with the CRR Working Group. Association members can email kelly.lovell@fola.ca for access to the question and answer session.
April 22, 2025: FOLA writes to the Attorney General of Ontario requesting an extension of time and an in-person meeting. The letter is here.
April 28, 2025: FOLA writes to the Attorney General of Ontario requesting a reconstitution of the CRR Working Group, and to intervene and halt the advance of the proposals int heir current form. The letter is here.
May 16, 2025: At the 2025 FOLA Spring Plenary – Annual General Meeting FOLA passes a resolution urging the Ontario government to ensure that ongoing reforms to the Rules of Civil Procedure are representative, evidence-based, and reflective of the diverse realities of civil litigation across the province.
